Terms of Service

Last updated: March 28, 2026. These Terms govern your access to and use of the Tavi web application and related services offered at heytavi.ca (the “Service”). By using the Service, you agree to these Terms. These Terms are subject to Canada's Anti-Spam Legislation (CASL) with respect to electronic messages.

1. Agreement

If you use the Service on behalf of an organization, you represent that you have authority to bind that organization. If you do not agree, do not use the Service.

2. Description of the Service

Tavi helps teams monitor community signals, prepare drafts, and run review workflows with policy and quality checks. Features may change as we improve the product. The Service is provided over the public internet using managed hosting and database infrastructure; we strive for reliability but do not guarantee uninterrupted access.

3. Accounts and security

You are responsible for safeguarding your credentials and for activity under your account. Notify us promptly if you suspect unauthorized access. We may suspend or terminate accounts that risk the security or integrity of the Service or other users.

4. Acceptable use

You agree not to:

  • Violate applicable laws or third-party rights
  • Attempt to probe, scan, or test the vulnerability of the Service without authorization
  • Interfere with or disrupt the Service or other users
  • Reverse engineer or attempt to extract source code except where permitted by law
  • Use the Service to generate or distribute unlawful, fraudulent, or harmful content

5. Your content

You retain rights to content you submit. You grant us a limited license to host, process, transmit, and display that content solely to provide and improve the Service for your organization. You represent that you have the rights needed to grant this license.

6. Third-party services

The Service relies on infrastructure and optional providers (for example, authentication, database, hosting, and AI inference). Their use is subject to their terms and privacy practices. We select providers to support security and confidentiality appropriate to a business application.

7. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. CONTENT AND AI OUTPUTS MAY BE INACCURATE OR INCOMPLETE; YOU ARE RESPONSIBLE FOR FINAL DECISIONS AND COMPLIANCE WITH YOUR INDUSTRY RULES.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED CANADIAN DOLLARS (CAD $100), IF NO FEES APPLIED. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS, DATA, OR GOODWILL.

9. Indemnity

You will defend and indemnify us against claims arising from your content, your misuse of the Service, or your violation of these Terms, to the extent permitted by law.

10. Termination

You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms or operational or legal reasons. Provisions that by their nature should survive will survive termination.

11. Governing law

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, excluding conflict-of-law rules. You agree to the exclusive jurisdiction of the courts of Alberta, subject to mandatory consumer protections where applicable.

12. Changes

We may modify these Terms by posting an updated version on this page. Material changes may be communicated through the Service or by email where appropriate. Continued use after the effective date constitutes acceptance of the updated Terms, where permitted by law.

13. Electronic communications (CASL)

By creating an account, you consent to receive transactional electronic messages from us that are necessary to operate the Service — for example, account confirmations, security alerts, password resets, and service notifications. These messages are sent under implied consent as permitted by Canada's Anti-Spam Legislation (CASL, S.C. 2010, c. 23).

We will not send you commercial electronic messages (such as marketing or promotional emails) without first obtaining your express consent. If we introduce commercial communications in the future, each message will include a clear and prominently displayed unsubscribe mechanism, our contact information, and will comply with all CASL requirements.
